Terms of Service

These Terms of Service ("Terms") govern your use of the digital memorial platform at eternalboard.com, operated by Eternal Board ("Eternal Board," "we," "us," or "our"). By creating a memorial, making a purchase, or otherwise using the Service, you agree to these Terms.
1. The Service
Eternal Board lets you create a digital memorial page for a loved one: a dedicated square on the Eternal Board, a portrait and photo gallery, an obituary and life story, a shareable QR code, and a family comment wall. Available tiers and what each includes:

2. Payments and Paddle as Merchant of Record
All purchases are processed by our online reseller, Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record for your transaction. Paddle handles billing, applicable taxes, and payment collection. Your purchase is also subject to Paddle's Buyer Terms. Eternal Board is responsible for fulfilling the memorial you purchase.
3. Standard tier subscription
The Standard tier is billed annually and renews automatically each year at the then-current price unless you cancel before the renewal date. You will receive an email reminder before renewal. You may cancel at any time; your memorial remains live for the remainder of the paid period, after which it is no longer publicly displayed. See our Refund Policy for cancellation and refund details.
4. Your content
You retain ownership of the photos, text, and other content you submit ("Memorial Content"). By submitting Memorial Content, you grant Eternal Board a non-exclusive, worldwide license to host, display, and reproduce it as necessary to operate the Service (for example, on the memorial page, in QR codes, and in printable certificates).
You represent that you have the right to submit the Memorial Content, including any photos and personal details about the person being memorialized, and that doing so does not violate the rights of any third party.
5. Prohibited content and conduct
You may not use the Service to submit content that is unlawful, defamatory, harassing, hateful, pornographic, fraudulent, or that infringes someone else's intellectual property or privacy rights. We may remove content or suspend access that violates these Terms, at our discretion.
6. Comments
The family comment wall allows visitors to leave remembrances. We are not responsible for comments left by third parties, but we may moderate or remove comments that violate these Terms.
7. Availability
We aim to keep the Service available and memorial pages accessible, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, and in rare cases the Service may be temporarily unavailable.
8. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, Eternal Board is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the tier giving rise to the claim.
10. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws applicable to Eternal Board's place of business, without regard to conflict-of-law principles, except where local consumer-protection law requires otherwise.
